The purchase of all travel services offered by Black Horizons Travel, LLC (also referred to in these terms & conditions as “BHT”), constitutes a contractual arrangement between you (also referred to in these terms & conditions as “Traveler”) and BHT, and represents your acceptance of BHT’s Terms & Conditions as set out herein. Travelers must be in good health to travel by plane, bus, train, walk during tours, and to climb stairs. BHT recommend travelers to obtain travel insurance.
Payments/Fees: BHT accepts payments via online Bill Pay and most major credit cards. A non-refundable deposit of $600 per person is required to confirm registration and is applied to the cost of the tour. The deposit is due during registration.
Invoices: Review and verify invoices thoroughly. Contact BHT within 7 days of receipt, if any information appears to be incorrect or incomplete. In the event of invoice errors, BHT reserves the right to re-invoice travelers with correct pricing.
Full Payment Due Date: The tour must be paid in full by July 15, 2020.
Travel Documents: BHT will request travelers to verify personal data prior to delivering official travel information. If travelers request to change information after June 30, 2020, suppliers may assess fees. BHT will bill such fees to travelers. Travel documents will be emailed to travelers 2-3 weeks prior to departure.
Cancellations/Fees/Refunds: Cancellations and refund requests must be in writing. If a cancellation is received before the final payment due date of a tour, the non-refundable deposit will be retained in addition to fees imposed by airlines, hotels, and transportation providers. If there is a remaining balance, the amount may be put towards a future BHT tour taking place within 365 days of the written cancellation.
- Until 90 days before departure: No cancellation fee.
- Until 60 days before departure: 25% cancellation fee.
- Until 30 days before departure: No refund possible.
- In the event of a cancellation by BHT or our suppliers, booked travelers will be entitled to a full refund including initial deposits.
Insurance: BHT highly recommends travel insurance. Discuss coverage with your preferred insurance provider.
Liability Statement: Neither Black Horizons Travel, its owners, partners, affiliates, or agents, shall be held liable for any act, default, injury, loss, expense, damage, deviation, delay, curtailment or inconvenience caused to or suffered by any person or their property, howsoever arising, which may occur or be incurred by any organization or person, where such act, default, injury, loss, expense, damage, deviation, delay, curtailment or inconvenience may have been caused or contributed to by defects or failures of any aircraft, vessel, automotive vehicle or other equipment or instrumentality under the control of independent suppliers. You further understand that if you purchase any optional activities that are not part of your pre-booked tour itinerary (including, without limitation, shore excursions, however, conducted, airline flights and ground transportation), these activities are operated by independent contractors; the contract for the provision of that activity will be between you and the third-party provider for such activity; BHT neither owns nor operates the third party supplier; and accordingly, you agree to seek remedies directly and only against the third party supplier and not hold BHT responsible for their acts or omissions
Choice of Law; Resolution of Disputes: Any and all controversies or claims arising out of or relating to this Agreement, including without limitation all claims related to bodily injuries, property damages or deaths, shall be settled by binding arbitration in the State of Arizona, USA in accordance with the rules of the American Arbitration Association then existing, and judgment on the arbitration award may be entered in any court having jurisdiction over the subject matter of the controversy. This agreement to arbitrate does not waive or modify the liability release contained in this document. Such proceedings will be governed by substantive Arizona law. The dispute will be resolved by a single arbitrator who must be a lawyer admitted to practice in the courts of at least one state in the United States and have a minimum of fifteen years of experience in civil litigation. The arbitrator so described will be selected by the American Arbitration Association. Each party to the dispute shall have the right on a single occasion to veto the designation of an arbitrator so selected. The parties waive the right to rely on any state law or statute which creates an exception to enforcement of the requirement that disputes be resolved pursuant to arbitration in the manner set forth in this provision.
